2. SMS Disclosure (Required for A2P 10DLC Compliance)
By using our platform and providing customer contact data, you agree to the following terms governing SMS messaging:
Types of Messages: Customers may receive messages including:
Review request notifications
Appointment or service reminders
Account status messages (e.g., opt-in confirmations, 2FA codes)
Customer satisfaction surveys
Marketing or promotional content (only if explicitly opted-in)
Message Frequency: Message frequency may vary based on customer engagement, your settings, and campaign activity.
Opt-Out Instructions: All SMS messages will include the instruction: "Text STOP to opt out." Customers may reply “STOP” at any time to unsubscribe.
Help Instructions: "Text HELP for help." Customers will receive support contact information via SMS.
Message and Data Rates: Message and data rates may apply based on the recipient’s mobile plan.
Privacy and Consent: You must have valid opt-in consent from customers before messaging. Customer mobile numbers and consent status must not be shared or sold to third parties for marketing purposes.

You are responsible for ensuring that your customer lists are compliant and legally obtained.
3. Account Responsibilities
You are responsible for all activity under your account, including ensuring lawful use of uploaded customer data. You agree to:
Maintain the confidentiality of your login credentials
Use the service only for its intended purposes
Notify us of any unauthorized access
4. Customer Data and Consent
You represent and warrant that:
You have proper legal authority to upload or sync customer contact data
All customer data is accurate and lawfully obtained
Customers have expressly opted in to receive SMS and/or email messages
You are solely responsible for all content you transmit using our platform.
5. Prohibited Uses
You may not use the platform to:
Send messages to individuals without prior consent
Engage in spam, phishing, or deceptive marketing
Violate any local, state, federal, or carrier communication laws
Violations may result in immediate suspension or termination of your account.
6. Fees and Payments
You agree to pay all applicable subscription and service fees. Payments are due monthly or annually, depending on your plan. Failure to pay may result in service suspension.
7. Intellectual Property
All content, code, and trademarks on the platform remain the property of VALUMAITION LLC. You may not copy, modify, or reverse engineer any portion of the platform.

We may suspend or terminate your account for:

Payment issues or misuse of services
You may request cancellation at any time. Upon termination, we may delete all related data, unless retention is required by law.

That messages will be delivered by all carriers
Specific results or increases in review volume
That the platform will be error-free or uninterrupted
Use of the platform is at your own risk.
10. Limitation of Liability
To the extent permitted by law, VALUMAITION LLC shall not be liable for indirect, incidental, or consequential damages. Our maximum liability shall not exceed the amount paid to us in the 12 months preceding a claim.
11. Indemnification
You agree to indemnify and hold harmless VALUMAITION LLC from any claims, damages, or legal actions resulting from:
Your use of the platform
Any SMS or email content you transmit
Violations of law or customer rights
12. Governing Law
These Terms are governed by the laws of the State of Hawaii. Any disputes shall be resolved in the courts of Honolulu County, HI.
13. Changes to These Terms
We may update these Terms at any time. Continued use of the service after changes constitutes your acceptance.
